By downloading, installing, or using the KinConnect application ("the App"), you agree to be bound by these Terms of Service ("Terms") as provided by OmniConnect LLC ("we," "our," "us"), a Texas limited liability company. If you do not agree to these Terms, please do not use the App.
To create an account on KinConnect, you must have a valid Apple ID, which is subject to Apple's own age and eligibility requirements. Family members who do not hold their own accounts may be represented as profiles created and managed by the family's designated administrator.
KinConnect is available through auto-renewable subscription plans offered via Apple's App Store. Current plan details and pricing are displayed within the App and on the App Store prior to purchase. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You may manage or cancel your subscription at any time through your Apple ID account settings. OmniConnect LLC does not process payments directly; all billing is handled by Apple.
KinConnect operates on a family administration model. One designated administrator purchases the subscription and manages permissions, invitations, and member access within the family network. The administrator is responsible for overseeing the appropriate use of the App within their family group. Members join by accepting an invitation from the administrator.
You are solely responsible for all content you create, upload, or share within the App, including text, photos, audio, and any other media. You agree not to use KinConnect to:
OmniConnect LLC does not monitor or review user content. However, we reserve the right to remove content or suspend accounts that we become aware are in violation of these Terms or applicable law.
Certain categories of content within the App are designed to auto-delete after a limited period. This is a core feature of the App and is clearly disclosed within the user interface. Once content is auto-deleted, it cannot be recovered by OmniConnect LLC or any third party. It is your responsibility to preserve any content you wish to retain by using the App's available preservation features before the auto-deletion period expires. OmniConnect LLC is not liable for any content that is deleted in accordance with the App's normal operation.
The privacy architecture of KinConnect carries inherent responsibilities that you accept by using the App:
The App may include features that allow the designated administrator to transfer ownership of the family network to another user. Such transfers are subject to the confirmation process described within the App. Once a transfer is finalized, it may not be reversible. OmniConnect LLC is not responsible for disputes between users regarding account ownership or administrative control.
The KinConnect application, including its design, code, features, branding, and all associated intellectual property, is owned by OmniConnect LLC and is protected by applicable copyright, trademark, and other intellectual property laws. You retain ownership of the content you create and share through the App. By using the App, you grant OmniConnect LLC a limited, non-exclusive license solely to the extent necessary to operate the service and deliver your content to your intended recipients within your family network. We do not use your content for advertising, marketing, or any purpose unrelated to providing the service.
Your privacy is important to us. Our collection, use, and handling of data is described in our Privacy Policy, which is incorporated into these Terms by reference.
The App is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, OmniConnect LLC disclaims all warranties, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or free of harmful components, or that any data stored through the App will be preserved indefinitely. KinConnect is a family communication tool and does not provide medical, legal, financial, or professional advice of any kind. Any wellness-related features within the App are intended for general informational and personal reflection purposes only.
To the fullest extent permitted by applicable law, OmniConnect LLC, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of content, loss of profits, personal injury, or emotional distress, arising out of or in connection with your use of the App, regardless of the theory of liability. In no event shall OmniConnect LLC's total cumulative liability exceed the amount you have paid to OmniConnect LLC (through Apple's App Store) in the twelve (12) months immediately preceding the event giving rise to the claim.
You agree to defend, indemnify, and hold harmless OmniConnect LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any content you create, upload, or share through the App.
OmniConnect LLC reserves the right to modify, update, suspend, or discontinue any part of the App or its features at any time, with or without notice, for any reason. We will make reasonable efforts to notify users of significant changes that materially affect the service. OmniConnect LLC shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App or any of its features.
We reserve the right to suspend or terminate your access to the App at our discretion if we reasonably believe your use violates these Terms or applicable law. You may terminate your account at any time through the App's settings. Upon termination, your right to use the App ceases immediately. Sections of these Terms that by their nature should survive termination (including Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law) shall continue to apply.
OmniConnect LLC shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, internet or telecommunications failures, power outages, third-party service disruptions (including Apple's infrastructure), or any other event that could not have been reasonably foreseen or prevented.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of such courts.
Severability: If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and OmniConnect LLC regarding the use of the App and supersede any prior agreements or understandings.
No Waiver: The failure of OmniConnect LLC to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
We may update these Terms from time to time to reflect changes in our practices or for legal, regulatory, or operational reasons. We will notify users of material changes via in-app notification or other reasonable means. Your continued use of the App after such notification constitutes your acceptance of the updated Terms.
