By downloading, installing, or using the KinConnect application ("the App"), you agree to be bound by these Terms of Service ("Terms") as provided by OmniConnect LLC ("we," "our," "us"), a Texas limited liability company. If you do not agree to these Terms, please do not use the App.
To create an account on KinConnect, you must have a valid Apple ID, which is subject to Apple's own age and eligibility requirements. Family members who do not hold their own accounts may be represented as profiles created and managed by the family's designated administrator, or may be invited as minor accounts by their parent or legal guardian through Apple Family Sharing.
KinConnect is available through auto-renewable subscription plans offered via Apple's App Store. Current plan details and pricing are displayed within the App and on the App Store prior to purchase. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You may manage or cancel your subscription at any time through your Apple ID account settings. OmniConnect LLC does not process payments directly; all billing is handled by Apple.
KinConnect operates on a family administration model and may allow you to participate in multiple family networks and custom sharing subgroups ("Circles"). Within each family network, a designated administrator purchases the subscription (permitting up to 10 active members on the Standard plan or up to 50 active members on the Extended plan) and manages permissions, invitations, Circle memberships, and member access. The administrator is responsible for overseeing the appropriate use of the App within their family group and obtaining any required verifiable parental consent before creating profiles for or inviting minors. By joining a family network or sharing content within any family space or Circle, you acknowledge that the administrator has the technical authority to add or remove members, modify Circle access, rotate access permissions, or delete the family network, any of which may immediately terminate a member's access to shared content. You are solely responsible for verifying the specific family network, Circle, or recipient audience you select before posting or sending any content. If you belong to multiple family networks and choose to pause a joined family space in Profile settings, pausing operates solely as a personal display and notification-quieting preference across your synced devices: it hides that family's everyday views and suppresses new notification banners, sounds, and main badge counts once iCloud synchronization completes, while retaining a subtle unread dot in Profile, continuing essential account and security updates, and leaving your membership and previously shared content visible to that family. Posts or media you already submitted prior to pausing may finish uploading, and push notifications already in transit from Apple Push Notification service (APNs) prior to subscription reconciliation may still arrive. OmniConnect LLC cannot control and is not responsible for the actions of any administrator or invited member, including any member who captures (such as via screenshot, screen recording, photograph, or export) or re-shares content outside the App, nor is OmniConnect LLC liable for any notification or update missed while a family space is paused or delivered while in flight.
You are solely responsible for all content you create, upload, or share within the App, including text, photos, video, audio, links, calendar events, polls, recipes, and family tree records. You agree not to use KinConnect to:
OmniConnect LLC does not monitor or review user content. On supported devices, the App may invoke Apple's on-device SensitiveContentAnalysis and DeclaredAgeRange frameworks to display local warnings before potentially sensitive media is viewed or shared; however, such automated operating-system classifiers depend on device configuration, may fail to detect objectionable material (false negatives) or may flag benign content (false positives), and can be bypassed or disabled on a user's device. On-device safety features are not a guaranteed content-moderation filter and do not replace adult and parental supervision. However, we reserve the right to remove content or suspend accounts that we become aware are in violation of these Terms or applicable law.
Certain categories of content within the App (such as ephemeral chat messages) are designed to auto-delete after a limited period, while other features (such as Time Capsules) are designed to seal content until a designated future unlock date. These behaviors are core features of the App and are disclosed within the user interface. Once content is auto-deleted, or if a user or administrator deletes content, a Circle, or a family vault, it cannot be recovered by OmniConnect LLC or any third party. Furthermore, the future unlocking and availability of any Time Capsule or scheduled content requires an active subscription, intact family encryption keys, and continuous storage within Apple's CloudKit infrastructure; if encryption keys are lost, an account or vault is deleted, or a subscription expires prior to the unlock date, sealed Time Capsule content may be permanently lost. Time Capsule unlock timing is evaluated on a best-effort basis using device and network reachability clocks and is not a cryptographically time-locked escrow against device-clock manipulation or time-zone differences. It is your sole responsibility to preserve any content you wish to retain by maintaining independent copies before deletion occurs. OmniConnect LLC is not liable for any content—including any Time Capsule, message, photo, video, audio recording, recipe, poll, calendar event, or family tree record—that is deleted, inaccessible, unlocked early or late, or delayed or failed in delivery.
The privacy architecture of KinConnect carries inherent technical responsibilities that you expressly accept by using the App:
CoreSpotlight search, Siri, or App Shortcuts may surface indexed titles, previews, or family items outside the App. OmniConnect LLC is not liable if an authorized family or Circle member views, screenshots, screen-records, photographs, exports, or redistributes content shared within the App, if you post content to an unintended Circle or family group, or if an unauthorized person gains access to an unlocked device, local Spotlight/Siri results, or compromised Apple ID / iCloud credentials.The App may include features that allow the designated administrator to transfer ownership of a family network to another active member during the administrator's lifetime, subject to the confirmation process described within the App. Once a transfer is finalized, it may not be reversible. OmniConnect LLC is not responsible for disputes between users regarding account ownership or administrative control.
No Estate-Planning or Post-Mortem Access Guarantee: References in the App or promotional materials to a "Legacy Vault," "Heritage Vault," "digital estate," "heirloom," or passing memories to the "next generation" describe the App's intended family-sharing experience and do not create a legal trust, testamentary instrument, fiduciary relationship, custodial escrow, or guaranteed archival service. Because OmniConnect LLC has no access to your encryption keys or Apple ID credentials, we cannot honor death certificates, wills, letters testamentary, powers of attorney, or probate court orders to unlock, decrypt, or transfer a family vault after an administrator's death or incapacity. Continuity of access across generations depends entirely on living administrative actions taken prior to incapacity or death (such as completing an in-app ownership transfer, maintaining an active subscription, keeping independent backups, or configuring Apple's own iCloud Legacy Contact feature, which is governed solely by Apple). If an administrator dies, becomes incapacitated, or loses Apple ID access without completing such measures, the vault and all encrypted content within it may be permanently lost.
The KinConnect application, including its design, code, features, branding, and all associated intellectual property, is owned by OmniConnect LLC and is protected by applicable copyright, trademark, and other intellectual property laws. You retain ownership of the content you create and share through the App. By using the App, you grant OmniConnect LLC a limited, non-exclusive license solely to the extent necessary to operate the service and deliver your content to your intended recipients within your family network. We do not use your content for advertising, marketing, or any purpose unrelated to providing the service.
Your privacy is important to us. Our collection, use, and handling of data is described in our Privacy Policy, which is incorporated into these Terms by reference.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OMNICONNECT LLC AND ITS FOUNDERS, OWNERS, MEMBERS, MANAGERS, OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, LICENSORS, AND AGENTS (COLLECTIVELY, THE "OMNICONNECT PARTIES") EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP OR APPLE'S CLOUDKIT INFRASTRUCTURE WILL BE UNINTERRUPTED, ERROR-FREE, TIMELY, OR IMMUNE FROM COMPROMISE, THAT ANY ON-DEVICE AI, OCR RECIPE SCAN, VOICE TRANSCRIPTION, OR COMMUNICATION SAFETY CLASSIFIER WILL BE ACCURATE OR COMPLETE, OR THAT ANY ENCRYPTED DATA, LEGACY VAULT ITEM, OR TIME CAPSULE WILL BE PRESERVED INDEFINITELY OR RECOVERABLE FOLLOWING KEY LOSS, DEVICE LOSS, OR ACCOUNT LOSS. KinConnect is a family communication tool and does not provide medical, psychological, therapeutic, clerical, theological, culinary/allergen-safety, elder-care, emergency-monitoring, legal, estate-planning, financial, or professional advice or services of any kind. Any wellness, Happy Lab, Daily Uplift, Faith & Inspiration, mood, reflection, Presence Halo, or Up & About (formerly Wellness Indicator) features within the App are intended for general informational and personal connection purposes only, carry no guarantee of emotional or health outcomes, and must never be relied upon for medical, mental-health, safety, or emergency decisions.
Marketing Descriptions vs. Technical & Legal Limitations: Promotional, editorial, and descriptive statements on our website, App Store listings, or marketing materials—including phrases such as "Your Data, Your Fortress," "Zero-Knowledge Sanctuary," "Absolute Privacy," "100% private space," "closed-loop network," "OmniLock," "Legacy Vault," "Heritage Vault," "permanent," "heirloom," "safeguarded for the future," "OLED protection," "cognitive priming," "rewiring," "brain medicine," or "happiness baseline"—describe the architectural design goals and intended user experience of the App relative to ad-supported public social networks. Such statements do not constitute express warranties, clinical or health guarantees, guarantees of absolute immunity from human or endpoint compromise, or promises of perpetual data preservation. In the event of any conflict or ambiguity between promotional materials and these Terms (or our Privacy Policy), these Terms and our Privacy Policy shall govern and control.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ANY OF THE OMNICONNECT PARTIES (INCLUDING OMNICONNECT LLC AND ITS FOUNDERS, OWNERS, MEMBERS, MANAGERS, OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND AGENTS) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, IRREVERSIBLE LOSS OF ENCRYPTION KEYS, LOSS OF PHOTOS, VIDEO, AUDIO, TIME CAPSULES, OR FAMILY RECORDS, UNAUTHORIZED DISCLOSURE OR SCREENSHOTS BY INVITED MEMBERS, ACCIDENTAL SHARING TO AN UNINTENDED FAMILY OR CIRCLE, DELAYED, SUPPRESSED, OR IN-FLIGHT NOTIFICATIONS OR QUEUED UPLOADS ASSOCIATED WITH PAUSING OR RESUMING A FAMILY SPACE, DELAY, INACCURACY, OR OMISSION IN ANY PRESENCE HALO OR UP & ABOUT (OR WELLNESS INDICATOR) STATUS OR BACKGROUND RECOVERY WAKE OR RELIANCE THEREON FOR HEALTH OR SAFETY PURPOSES, ERROR OR OMISSION IN ANY ON-DEVICE AI OUTPUT, VOICE TRANSCRIPTION, OR OCR-SCANNED OR SHARED RECIPE (INCLUDING ANY FOOD ALLERGY, DIETARY REACTION, OR FOODBORNE ILLNESS), DISPLAY BURN-IN OR BATTERY/HARDWARE WEAR FROM FRAME MODE, LOSS OF PROFITS, PERSONAL INJURY, OR EMOTIONAL DISTRESS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING THE OMNICONNECT PARTIES' OWN NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL THE OMNICONNECT PARTIES' TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS IN THE AGGREGATE ACROSS YOU AND ALL MEMBERS OF YOUR FAMILY NETWORK EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT ACTUALLY RECEIVED BY OMNICONNECT LLC FROM THE SUBSCRIBING ADMINISTRATOR FOR YOUR FAMILY NETWORK IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50.00).
You agree to defend, indemnify, and hold harmless the OmniConnect Parties (including OmniConnect LLC and its founders, owners, members, managers, officers, directors, employees, affiliates, and agents) from and against any and all claims, demands, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any applicable law or third-party right (including privacy, publicity, or intellectual property rights); (d) any content you create, upload, or share through the App, including any error in selecting a target family network or Circle; or (e) any dispute between family or Circle members, any act or omission of a user you invite or profile you administer (including profiles created for or invitations sent to minors), or any capture, screenshot, export, or external sharing of content by an invited member.
OmniConnect LLC reserves the right to modify, update, suspend, or discontinue any part of the App or its features at any time, with or without notice, for any reason. We will make reasonable efforts to notify users of significant changes that materially affect the service. None of the OmniConnect Parties shall be liable to you or any third party for any modification, suspension, or discontinuation of the App or any of its features.
We reserve the right to suspend or terminate your access to the App at our discretion if we reasonably believe your use violates these Terms or applicable law. You may terminate your account at any time through the App's settings. Upon termination, your right to use the App ceases immediately. Sections of these Terms that by their nature should survive termination (including Data Retention, Important Information About Your Data, Account Transfers, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law & Dispute Resolution) shall continue to apply.
None of the OmniConnect Parties shall be liable for any failure or delay in performing obligations under these Terms due to circumstances beyond reasonable control, including but not limited to natural disasters, acts of government, internet or telecommunications failures, power outages, operating system changes, third-party service disruptions (including Apple's CloudKit, iCloud, APNs, or App Store infrastructure), or any other event that could not have been reasonably foreseen or prevented.
These Terms and any dispute or claim arising out of or relating to these Terms, the App, or any of the OmniConnect Parties (whether in contract, tort, statute, or otherwise) shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Before initiating any legal proceeding, the complaining party must first send a written Notice of Dispute to kinconnect@omniconnecthq.com describing the nature and basis of the claim and the relief sought, and allow sixty (60) days for the parties to attempt in good faith to resolve the dispute informally. Any legal action or proceeding not resolved informally shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you irrevocably consent to the personal jurisdiction and venue of such courts. Any claim must be filed within one (1) year after the cause of action accrues, or the shortest period permitted under applicable Texas law (not to exceed two (2) years), or be permanently barred.
CLASS ACTION & JURY TRIAL WAIVER: TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND THE OMNICONNECT PARTIES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. FURTHERMORE, EACH PARTY KNOWINGLY, VOLUNTARILY, AND IRREVOCABLY WAIVES ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION OR PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP.
Severability: If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and OmniConnect LLC regarding the use of the App and supersede any prior agreements or understandings.
No Waiver: The failure of OmniConnect LLC to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
We may update these Terms from time to time to reflect changes in our practices or for legal, regulatory, or operational reasons. We will notify users of material changes via in-app notification or other reasonable means. Your continued use of the App after such notification constitutes your acceptance of the updated Terms.
